THE PHILIPPINE ANTI CYBERCRIME LAW OR RA 10175





What do you think of the Law? Have you reacted to it, posted your disagreements regarding the Law and so on? But, what is Republic Act 10175 or Cybercrime Law per se?

I was browsing the internet one day and have seen a lot of posts talking about the Cybercrime Law. To be honest, I wasn’t aware that its going to be passed right away compared to bills that are more important and helpful for the development of our country as such. I did not post any signs of disagreement with regard to the Law though because I wasn’t familiar with it yet, so I decided to search on the web what it is all about. Here’s a highlight of what I’ve read.

This Act shall be known as the “Cybercrime Prevention Act of 2012
The State is responsible to safeguard the integrity of computers, communication systems, databases as well as the information and data available or stored to it for possible access, alteration and interception without having the proper authority to do it.
Cybercrime Offenses:
·         Offenses against the confidentiality, integrity and availability of computer data and systems
-      Illegal Access and interception (using the computer system, downloading of computer data without proper authority)
-      data and system interference (damaging computer data, transmission of viruses)
-      misuse of computer programs, passwords, access codes and such
-      Cyber-squatting or acquiring a domain in bad faith for the purpose of destroying its reputation
·         Computer related Offenses
-      Computer related forgery (unauthorized input, alteration and deletion of computer data to produce a fraudulent one that will still be used for legal purposes)
-      Computer-related Fraud(unauthorized input, alteration, deletion and interference of computer system causing damage to it)
-      Computer-related Identity Theft
·         Content-related Offenses
-      Cyber sex
-      Child Pornography
-      Unsolicited Commercial Communications
·         Libel
·         Other Offenses
-      Aiding and attempt in the commission of cybercrime.


Skimming quickly through the whole RA 10175 makes me think that the Law itself is too wispy. A person found guilty to commit the above offenses is to be punished. No grounds and no requisites. Anyway, all has been said and done. The blame regarding this matter should be equally shared. There’s nothing we can do about it but to make ourselves familiar with the Law. Legislators and other branch of the government on the other hand should review the Law itself for amendments. Bottom line? Encompassing our responsibilities.
